Abstract: The first part of the course acts as an introduction, giving a general outline of the subject, with particular emphasis on the technical and legislative particularities of the field, on the issues concerning the "transfer of functions" and on the new area of corporate liability. The second part of the course offers a detailed analysis of the most important cases of bankruptcy and corporate crimes. The aim is to provide students with a solid grounding in the specifics of these areas of criminal legislation. The course also seeks to analyse, through the use of argumentation and logic, the means of application of criminal law by examining and assessing some practical cases.

Abstract:

The objective of this course is that of examining the main aspects of criminal law legislation as applied to the activity of enterprises. In this connection, particular attention will be devoted to the examination of the treatment of offenses in bankruptcy, corporate and tax legislation. At the end of the course the student will be able to: (a) discern the problems inherent in the identification of persons that are to be considered as criminally liable; (b) identify the potential criminal behavior that can be committed in the activity of enterprises; (c) assess possible criminal responsibility of the professional profiles.

Abstract: This course begins with an analysis of new forms of crime and unlawful behaviour which are apparent in every sphere of social and economic life, given the increasingly extensive and capillary use of computers. It seeks to provide students with a framework of the main gaps in the law and the need for protection which have emerged in the face of the impact of this new technology, while bearing in mind the principle of legality and the ban on analogies that disadvantage the defendant in criminal law.
